302.311. Suspension or revocation — appeals from — procedure.
You can appeal a driver’s license suspension or revocation in court.
If your license is denied, suspended, or revoked, you have the right to appeal the decision in your county’s circuit court within 30 days of getting the notice.
1. If your license is denied, suspended, or revoked, you can file an appeal in the circuit court of your home county within 30 days of the notice.
2. The court will hear the case from the beginning (“de novo”) and can:
- Order the director to issue the license
- Keep the suspension or revocation in place
- Change or cancel the decision
- Revoke the license
3. You can appeal the circuit court’s decision just like in other civil cases.
4. The county prosecuting attorney will represent the director in the appeal process.
