§ 562.086 – Mental Illness as a Criminal Defense in Missouri

562.086. Lack of responsibility because of mental disease or defect.

Mental illness may be a defense if the person didn’t understand what they were doing.

If someone has a serious mental illness that kept them from knowing what they were doing or that it was wrong, they might not be held responsible for the crime.

1. A person is not criminally responsible if, at the time of the act, they had a mental disease or defect that made them unable to understand what they were doing or that it was wrong.

2. The rules for using this defense follow the laws outlined in chapter 552 of the Missouri Revised Statutes.
