You can ask for a hearing if your license is suspended — and may get a temporary permit while you wait.
If you receive a notice that your license is being suspended or revoked, you can ask for an administrative hearing within 15 days. You might also get a temporary permit to keep driving until a decision is made.
1. You have 15 days from the date you get the suspension or revocation notice to request a hearing. You can surrender your license when you request the hearing.
2. If you hold a valid Missouri license and surrender it, the Department of Revenue will give you a temporary permit that lasts until your hearing date. More temporary permits may be issued to delay the suspension until a final decision is made.
3. Hearings can be held by phone or in-person at a regional location if requested. The hearing will be run by licensed Missouri attorneys employed by the department.
4. The hearing only looks at one question: Did the person drive under the conditions described in section 302.505? The state must prove this. If proven, the suspension stands. If not, the suspension is canceled.
5. Hearings follow rules under chapter 536 and sections 302.500 to 302.540. Certified police reports are allowed as evidence.
6. The department must notify you of the hearing result, including the reason for its decision. This notice will also say that the decision becomes final in 15 days unless you appeal in the county where the arrest happened.
7. If you don’t appeal within 15 days, the decision becomes final.
8. The director may make rules to carry out this law.
