565.027. Involuntary manslaughter, second degree, penalty.

Covers deaths caused by criminal negligence

This law defines second-degree involuntary manslaughter in Missouri and outlines the penalties, including tougher punishment when the victim is a law enforcement officer or their close relative.

1. A person commits second-degree involuntary manslaughter if they cause someone’s death by acting with criminal negligence.

2. This is normally a class E felony. But if the victim was:

  • Intentionally targeted and is a law enforcement officer, or
  • Intentionally targeted because they are a close family member (within the second degree) of a law enforcement officer,

then it becomes a class D felony.
