562.051. Conviction of different degrees of offenses.

Each person is judged by their own actions and intent.

When multiple people are involved in a crime with different levels (like first- or second-degree), each person can be convicted based on what they personally did and meant to do.

1. If more than one person is responsible for a crime that has different degrees, each one can be found guilty of a different degree. This depends on:

  • Their own mental state (what they intended or knew), and
  • Whether they were personally involved in facts that make the crime worse (aggravating) or less serious (mitigating).
