579.020. Delivery of a controlled substance — penalties.

It’s illegal to sell, share, or try to sell drugs

This law makes it a crime to give, sell, or even try to give or sell illegal drugs—including letting minors handle them.

1. A person breaks this law if they do any of the following without legal permission:

  • Knowingly give, sell, or deliver illegal drugs;
  • Try to give, sell, or deliver illegal drugs;
  • Have drugs with plans to give, sell, or deliver them;
  • Let a minor buy or move illegally obtained drugs.

2. The crime is usually a Class C felony unless it involves a small amount of marijuana or other special situations.

3. If the amount is 35 grams or less of marijuana or synthetic cannabinoid, it is a Class E felony.

4. Giving or selling 35 grams or less of marijuana or synthetic cannabinoid to someone under 17 who’s at least 2 years younger than you is a Class C felony.

5. It becomes a more serious Class B felony if:

  • You deliver any amount of drugs (other than up to 35g of marijuana/synthetics) to someone under 17 who is at least 2 years younger than you;
  • You knowingly let a minor buy or transport illegally obtained drugs.
