579.015. Possession or control of a controlled substance — penalty.

It’s illegal to have drugs unless the law allows it

This law makes it a crime to knowingly have any illegal drug, unless you’re allowed to by law (like with a prescription).

1. You commit this offense if you knowingly possess a controlled substance and don’t have legal permission under Missouri or federal law.

2. Penalties vary by the type and amount of drug:

  • Class D felony: Any controlled substance except 35 grams or less of marijuana or synthetic cannabinoids.
  • Class A misdemeanor: More than 10 grams but 35 grams or less of marijuana or synthetic cannabinoids.
  • Class D misdemeanor: 10 grams or less of marijuana or synthetic cannabinoids (first offense).
  • Class A misdemeanor: 10 grams or less of marijuana or synthetic cannabinoids if you’ve been found guilty of any drug offense before.

3. Prosecutors don’t have to list legal exceptions (like medical use) in charges—

It’s up to the defendant to prove that one applies.
