573.035. Promoting child pornography in the second degree — penalties.
It’s a felony to share or plan to share child pornography involving anyone under 18.
This law makes it a crime to promote or intend to promote child pornography involving minors under 18. The punishment is more severe if the material is shared with another minor.
1. A person commits this offense if they know the content is child pornography or obscene and:
- They possess it with the intent to promote it, or
- They actually promote or share it,
and it involves a real or apparently real minor under 18 years old.
2. The penalties are:
- Class D felony by default;
- Class e felony if shared knowingly with a minor;
- No probation is allowed for anyone found guilty of this offense.
