573.025. Promoting child pornography in the first degree — penalties.
It’s a felony to share or plan to share child pornography involving very young children.
This law makes it a serious crime to promote or intend to promote child pornography showing kids under 14. The punishment is even worse if it’s shared with another minor.
1. A person commits promoting child pornography in the first degree if they know the material is child pornography or obscene and:
- They possess it with the intent to share it, or
- They actually promote or share it,
and it involves a real or apparently real child under 14 years old.
2. The penalties are:
- Class B felony normally;
- Class A felony if the person shares the material with a minor;
- No probation, parole, or conditional release allowed for three years after being found guilty.
3. This law does not require internet or communication service providers to monitor what their users say or do.
