565.050. Assault, first degree, penalty.

Trying to kill or seriously hurt someone is first-degree assault

This law makes it a serious crime to try to kill someone or to seriously injure them on purpose. The punishment depends on how badly the victim is hurt and who the victim is.

1. A person commits first-degree assault if they try to kill someone or purposely cause—or try to cause—serious physical harm.

2. This crime is usually a class B felony. But it becomes a class A felony if:

  • The victim is seriously hurt, or
  • The victim is a “special victim” (like a police officer, firefighter, child, or other protected person defined in section 565.002).
