578.425. Felony committed to promote or assist criminal conduct by gang members, punishment in addition to regular sentences.

Extra prison time for helping a gang commit a felony

If you commit a felony to help a gang, the court will add extra prison time. You could get even more time if it’s near a school, a violent felony, or a very serious crime.

1. If someone is convicted of a felony done to benefit or assist a gang, they will be punished with extra prison time:

  1. (1) If it’s a felony, they’ll get 2 more years in prison. If it happened on or within 1,000 feet of a school, they’ll get 3 more years instead.
  2. (2) If it’s a dangerous felony, they’ll get 5 more years added to the sentence.
  3. (3) If the felony is one that can get life in prison or the death penalty, they won’t be eligible for parole until at least 15 years have been served.
