Rules for drawing blood for alcohol testing
This law explains who can draw blood for alcohol testing, how it must be done, and what information the tested person has a right to receive.
1. A blood test for alcohol must be done by a licensed doctor, nurse, phlebotomist, or trained medical technician—only if:
- The person agrees to it, or
- A judge issues a warrant.
2. Medical staff can refuse to draw blood if they believe it would risk the person’s health or life.
3. Only these medical professionals are allowed to draw blood. This rule does not apply to breath, saliva, or urine tests, which can be done by others.
4. The blood draw must use:
- A new, sterile needle,
- A sterile container, and
- Follow standard medical procedures.
5. If the tested person asks, they must be given full information about the test done by the police’s request.
