577.017. Consumption of alcoholic beverages while driving — penalty.

You can’t drink alcohol while driving on public roads

This law makes it illegal to drink alcohol while you’re driving a moving vehicle on any public road. It’s not a criminal charge, but it’s still against the law.

1. A person breaks this law if they drink any alcoholic beverage while driving a moving vehicle on any public road, including state and county roads, streets, avenues, boulevards, parkways, or alleys in a city or town.

2. This offense is an infraction. It does not show up on driving records kept by the Department of Revenue.
