573.030. Promoting obscenity in the second degree — penalties.
It’s a crime to make or sell obscene or pornographic material for money — especially to minors.
This law punishes people who create, sell, or show obscene or pornographic material for profit, including content made for or sent to minors.
1. A person commits promoting obscenity in the second degree if they know what the material is and do any of the following for money (pecuniary gain):
- (1) Promote or have obscene material with plans to promote it;
- (2) Make, show, direct, or take part in an obscene performance;
- (3) Promote or have material that is pornographic for minors with plans to promote it;
- (4) Make, show, direct, or take part in a performance that is pornographic for minors;
- (5) Share or take part in a pornographic performance for minors online or by computer, if they send it to someone they know is a minor.
2. This crime is a class A misdemeanor. But if the person has already been convicted of this offense before, it becomes a class E felony.
