573.020. Promoting obscenity in the first degree — penalty.

It’s a felony to distribute obscene or pornographic material — especially to minors.

This law makes it a serious crime to sell or share obscene content or pornographic material for minors, especially over the internet, if you know what it is and who it’s going to.

1. A person commits promoting obscenity in the first degree if they know the material is obscene or pornographic and do any of the following:

  • (1) Sell or distribute obscene material in large amounts (wholesale), or have it with plans to do so;
  • (2) Sell or distribute pornographic material for minors in large amounts, or have it with plans to do so;
  • (3) Share pornographic material for minors using a computer or the internet, if they send it to someone they know is a minor.

2. Promoting obscenity in the first degree is a class E felony.

3. “Wholesale promote” means to make, sell, send, or share something — or agree to — for the purpose of selling or giving it to others again.
