566.032. Statutory rape and attempt to commit, first degree, penalties.

It’s illegal to have sex with someone under 14, even if they agree.

Having sex with anyone younger than 14 is called first-degree statutory rape. It’s a serious felony with very harsh prison sentences.

1. A person commits this crime if they have sex with someone who is younger than 14 years old.

2. Statutory rape in the first degree (or trying to commit it) is a felony punishable by at least 5 years in prison or up to life. The punishment is more severe if:

  • (1) The act is especially violent or the victim is under 12 — then the prison term is at least 10 years or life.
  • (2) The offender has a history of serious sex crimes — they can get a longer sentence under repeat offender laws.
