§ 559.106 – Missouri Lifetime Probation for Sex Offenders

559.106. Lifetime supervision of certain sexual offenders — electronic monitoring — termination at age sixty-five permitted, when.

Some sex offenders must stay on probation for life with GPS tracking, unless a judge ends it after age 65.

If a person is convicted of certain sex crimes and put on probation, they may be watched for life and tracked electronically. Some may be released from this at age 65.

1. If someone is convicted of certain sex crimes and given probation, the court must order them to be supervised for life if:

  1. The crime was from section 566.030, 566.032, 566.060, 566.062, 566.067, 566.083, 566.100, 566.151, 566.210, 566.211, 568.020, 573.200, or 573.205 and happened on or after August 28, 2006; or
  2. The crime was from section 566.068, 566.069, 566.210, 566.211, 573.200, or 573.205 and happened on or after January 1, 2017, against a child under 14 and the offender had a past sex crime conviction.

2. A “prior sex offender” means someone found guilty of certain sex crimes before, including those involving intercourse with the victim.

3. These offenders must be tracked electronically using GPS or similar technology 24/7.

4. A judge may end the lifetime probation if the person is 65 or older and a risk assessment shows it’s appropriate.
