§ 559.026 – Detention During Probation in Missouri | Jail Time for Violations

559.026. Detention condition of probation.

Judges can add short jail time to probation if rules are broken.

If someone violates probation, the court or probation officer can make them spend up to a few days in jail as a consequence.

1. Judges can order up to 48 hours in jail at a time for violating probation, unless it’s just an infraction case. This can happen more than once while on probation.

2. In misdemeanor cases, detention can’t be longer than:

  • 30 days, or
  • The maximum jail sentence allowed for that crime—whichever is shorter.

3. In felony cases, detention can’t be more than 120 days total.

4. If probation is taken away and the person is sent to jail or prison, any time they already spent in detention for probation violations will count toward their sentence.
