§ 302.410 – License Suspension After Drug or Alcohol Offenses

302.410. Director of revenue to suspend or revoke license, when — hardship driving privileges may be granted, procedure — temporary instruction permits allowed, when.

The state will suspend or revoke licenses after drug or alcohol offenses — but hardship permits may be available.

If your license is taken away under certain drug or alcohol laws, the state will suspend or revoke it automatically. You might still qualify for a limited license if you need to drive for essential reasons.

1. When the Department of Revenue gets a court order under sections 302.400 or 302.405, it must:

  • Suspend the person’s license for 90 days, or
  • Revoke it for 1 year

If the person was under 16 at the time, the suspension or revocation starts on their 16th birthday. No additional hearing is required.

Anyone suspended or revoked under these laws can ask the circuit court for a hardship license. This process follows the same rules as in section 302.309.

2. Teens ages 15 to under 17 who lose driving privileges by court order under section 302.400 can still get a temporary instruction permit. This permit only allows driving with an approved instructor.
