To get your license back after a DUI-related suspension, you must complete a treatment program and pay fees.
If your license was suspended or revoked under Missouri DUI laws, you must finish a substance abuse program and pay all fees before it can be reinstated. You may challenge the program assignment in court if you disagree with it.
1. To get your license back after a suspension or revocation under sections 302.500 to 302.540, you must:
- Complete a Substance Abuse Traffic Offender Program (SATOP) or an approved equivalent
- Receive a written assignment based on an individual needs assessment
- Be informed that you can challenge this assignment in circuit court if you object
The court can change or cancel the assignment unless you are a prior or persistent offender or had a BAC of 0.15% or higher. In those cases, the court can only modify — not waive — the program. You must follow the court’s decision to get your license back.
2. You must pay:
- Program fees (amount set by the Department of Mental Health)
- A supplemental fee to fund SATOP programs
Program administrators must send fees to the state monthly (minus 2% for admin costs). Interest applies to late payments. Funds go to the mental health earnings fund.
3. If a program administrator fails to pay the fees within 6 months, the Missouri Attorney General will take legal action. Courts may also charge attorney’s fees and costs to the program.
4. If you were court-ordered to complete a SATOP due to the same incident that caused the suspension, that will count toward your reinstatement requirement.
5. The Department of Mental Health may create special treatment projects for serious or repeat offenders. These programs qualify as SATOP. A “serious or repeat offender” is someone with a BAC of 0.15% or more or a prior/persistent offender under section 577.001.
