Judges can give probation and treatment instead of jail if it’s safe
This law lets judges give probation with treatment instead of jail if the person isn’t a danger and needs help. It also tells judges to think about this option when the person has kids to care for.
1. A judge can place someone on probation and send them to a community-based treatment program if:
- Jail isn’t needed to protect the public, as long as there’s good supervision, and
- The person needs help—like training, guidance, or other support—that works better in a treatment program than in jail.
2. If the person is the main caregiver for one or more children, the judge must consider using a community-based program.
